Prominent Israeli rabbi faces criminal probe over anti-Arab remarks

Attorney General Yehuda Weinstein decided Tuesday to open a criminal investigation against Safed Chief Rabbi Shmuel Eliyahu, for alleged incitement to racism.

The decision to investigate Eliyahu came after he was quoted making several anti-Arab comments in interviews with the media.

Eliyahu was one of 18 rabbis who signed a petition in October 2010, urging Jews to refrain from renting or selling apartments to non-Jews – a move seen as being directed against Arab students enrolled in Safed’s college. Some 50 rabbis eventually endorsed the so-called "rabbis' letter."

The criminal investigation opened by Weinstein will not focus on "rabbis' letter," however, but rather on personal remarks made by Eliyahu.

After a series of complaints were lodged with the Attorney General's office regarding Eliyahu's anti-Arab remarks, Weinstein decided to investigate whether any criminal intention could be found in the remarks.

Eliyahu last year slammed those who have accused him of being a racist, saying that a survey showed that 74 percent of the public supports the letter. He added that he believed the letter had backing from God.

The rabbis of the right-wing NGO World Headquarters to Save the People and the Land of Israel denounced the move to indict Eliyahu, calling the decision "a crime against the Jewish people meant to humiliate Israel's rabbis and Torah."

"We urge Rabbi Shmuel Eliyahu do refrain from cooperating with the political investigation, which harkens to a darker time in Jewish history," the right-wing group said.

In another response to Eliyahu's indictment, the Follow-up Committee on Arab Education (FCAE) called the move "too little, and, mainly, possibly too late."

"Eliyahu's racist positions – which Arab students in Safed and around Israel have suffered and continue to suffer – are no longer a marginal phenomenon but have found their way to the majority of Israel's lawmakers and ministers, FCAE director Raja Za'atra said.

Za'atra added that racism was a "malignant" affliction, saying that if Israelis don't "fight it determinately, Jews and Arabs alike, it will bring an irreversible fascist disaster on us all."
Eliyahu, the son of former Sephardic Chief Rabbi Mordechai Eliyahu, is known for his extreme stances, and has been indicted in other occasions for incitement to racism. In one occasion, he called to remove all of Safed Academic College's Arab students following a suicide attack on a bus near Meron in northern Israel.

At the time, Eliyahu criticized Safed Academic College as a potential site for the creations of inappropriate relations between Jews and Arabs, saying that best possible solution for the issue was the forming of a separate Arab college.

In a 2004 interview, Eliyahu commented on posters distributed in Safed, which claimed that "Jewish girls were imprisoned by Arabs in the village of Akbara," saying that relations between Jewish women and Arab men were "another kind of war the Palestinians are waging against us, and we must know how to defend ourselves."

"There are Jewish girls, 15-25 years-old, seduced by young Arab men…. I also know that in many of the cases they were Arab men already married to Arab women, and those Jewish girls were taken as slaves of sort, without any possibility of escape," Eliyahu said.

American Jews petition Obama against Palestinian state

Reports in the Israeli media claim that around 100,000 American Jews have signed a petition to be presented to President Barak Obama, asking him to use the US veto at the UN Security Council against a resolution giving Palestine full member status. President Mahmoud Abbas presented the Palestinian Authority's application for UN recognition as an independent state last week.

According to Israel Radio, the petition says, "Since the establishment of the state of Israel, Arab countries have refused to recognize its right to exist as a Jewish state, and the Palestinian Authority holds on to that stance. And therefore, the US veto must be used against the PA's application for full member status for Palestine at the UN."

A London-based commentator called the wording of the petition "a blatant distortion of reality". MEMO's Ibrahim Hewitt pointed out that in 1948, "The Declaration of Independence of the State of Israel was clear that it was enacting 'the establishment of a Jewish state in Eretz-Israel, to be known as the state of Israel'." The Palestinian Liberation Organisation recognised the state of Israel in 1993 at the time of the Oslo Accords, so it gave de facto recognition to the Jewish character of the state. "This latest insistence on separate recognition of Israel as a distinctly Jewish state is," Hewitt claimed, "another obstacle intended to give Israel more time to build even more illegal settlements and make the possibility of a viable Palestinian state even more remote." The 100,000 signatories of the petition in America have been duped, added Hewitt. "They really should study the history of the conflict before getting conned in this way."

The petition was handed over to Israeli Minister of Information Yuli Edelstein, who is currently on a visit to New York, for him to pass on to the US Administration.

“We are saving lives any way we can, wherever we can,” said Rabbi Yechiel Eckstein, IFCJ founder and president. “The generosity of our donors throughout the United States and Canada makes it possible for Israelis — who must live with the threat of war and terrorist attack — to be protected while going about their daily lives.”

The mobile bomb shelters will be placed near schools and other public areas so they can be reached quickly in the event of an attack. After hearing a warning siren, people usually have only 15-20 seconds to get to the nearest shelter.

The prefabricated concrete bomb shelters will be installed as quickly as possible in at least 12 southern cities targeted by recent rocket attacks, including Ofakim, Ashkelon, Beersheba, and Ashdod.

Each shelter costs $10,000 and will accommodate approximately 28 people. There are at least 1 million people in need of access to emergency shelters in southern Israel.

In early August, Israel suffered one of its worst terrorist attacks in recent years. In a coordinated three-stage attack, eight Israelis were killed and another 30 injured. In the days that followed, more than 100 rockets were fired into Israel by terrorists from Hamas-controlled Gaza, killing one person and sending hundreds of thousands of Israelis fleeing to public and private bomb shelters throughout the country, if and where they exist.

Rockets and missiles continue to be launched into civilian areas on a near-daily basis.

With national security funds being diverted to defense needs and security for schools, officials at Israel’s Ministry of Defense asked Rabbi Eckstein for emergency assistance to purchase more bomb shelters for public areas.

Security programs for Jewish institutions

Since the Lebanon War, the IFCJ has funded the renovations or construction of 2,114 bomb shelters in the north and south regions hit by missile and rocket attacks.

“Our mission is to help the people of Israel in whatever way we can,” Rabbi Eckstein said, “beginning with their need for physical security and sustenance.”

The IFCJ also has committed more than $10 million this year to fund other security efforts in Israel. These include fortification of hospital trauma units where attack victims are treated; assistance to Israel Defense Forces soldiers, including those without families or whose families are in need; and helping soldiers with post-military education and job training programs.

Earlier this year, the IFCJ also provided funds for the renovation of 14 public bomb shelters in Beersheba, and earmarked $450,000 for renovating or building operation command centers in 14 municipalities in terrorist-targeted regions in the north and the south.

A number of municipalities also have received fire and security vehicles, thanks to IFCJ donors, most of whom are evangelical Christians.

As part of its mission to help Jews in need throughout the world, the IFCJ also supports security programs for Jewish institutions in Turkey, Morocco, the former Soviet Union, and other regions where Jewish schools, synagogues, and communities have been the target of terror attacks and bomb threats.

Every Saturday evening, Rabbi Yosef discusses halachic issues and the weekly Torah portion, often addressing current events as well – mostly without political correctness considerations. Two of the rabbi's statements have sparked a lot of anger, and even diplomatic tensions. Last Year, ahead of Rosh Hashana, Yosef wished death on Palestinian President Mahmoud Abbas and his people, who he called "evil enemies of Israel." The rabbi mentioned the blessing said at the Jewish New Year feast that states, "May our enemies and adversaries be destroyed," and applied it to the current situation. "Abu Mazen (Abbas) and all those evil men – may they perish from this world. May God Almighty strike them and these Palestinians."

In December, Yosef impliedthat the fire raging on Mount Carmel in northern Israel, which left dozens of wardens and firefighters dead, was a punishment from God for religious offenses committed by the area's residents.

The rabbi read a section from the Babylonian Talmud, which states that "the fire only exists in a place where Shabbat is desecrated." He recommended that people "study Torah, engage in good deeds, repent, observe Shabbat, and know the entire Halacha, and thanks to this God will apply a full recovery.

French JDL recruiting Jews with military experience to 'defend' Israeli settlements

Rightist group, founded by late Rabbi Meir Kahane, is bringing volunteers to counter Palestinian marches on settlements planned for week of September 20.

An extreme right-wing Jewish group in France is recruiting Jews with military experience for a solidarity mission to Israel in order to help “defend” Jewish settlements in the West Bank from Palestinian protesters who are expected to march toward some of them on or around September 20. 

The organization that put out the call for militant Jews is the French branch of the Jewish Defense League, or Kach, an organization established by Meir Kahane in the late 1960s and banned in the United States and Israel, but tolerated in France.

According to a spokesman for La Ligue de Defense Juive, the mission will take place between the 19th and 25th of September and will be made up of five groups of eleven people each, who will take “positions” in five different West Bank settlements. All expenses for the participants have been paid for by French donors that the group declined to identify.

The participants, French men and women between the ages of 23 and 34, all have military training, which was a prerequisite for joining the mission, says Amnon Cohen, a spokesman for the group, who himself was a soldier in the French Foreign Legion for 15 years. The plan, says Cohen, is not to “provoke the Arabs,” but rather to “be on hand in case the settlements need our help with defense if the Arabs attack… at this precarious time.”

In the U.S., the JDL is considered to be a violent, racist and extremist organization, and is on the FBI’s list of terrorist groups. Similarly, in Israel, the JDL’s sister movement Kach, as well as its offshoot Kahane Lives – whose stated goals included the violent expulsion of Arabs from the country-- were both outlawed in 1994, on the grounds that they were terror organizations, and as such, a threat to state security.

Over the years, LDJ has participated in a number of demonstrations in France, some of them violent. The group has protested a speaking event of an author known for anti-Israel views, a performance of a well known comic critical of Israel, a photography exhibit showing pictures of victims of war in Gaza, and the offices of various news organizations that the group believes to be biased against Israel.

The LDJ demonstrated against Palestinian politician Marwan Bargouti when was honored by a local municipality and also mounted a protest outside the Percy hospital when Palestinian leader Yasser Arafat was brought there for treatment, chanting: “Arafat, bastard, the Jews will have your skin.” Over the years, various leaders of the organization have clashed with the police and several have been arrested – but the group has not been outlawed.

The LDJ had no trouble organizing logistics for its upcoming mission to Israel, says Cohen, and everything has already been coordinated in advance with the five settlements that are awaiting their arrival. The participants will not fly to Israel as a group, added Cohen, but rather are coming on different days, independently of one another, leaving from Paris and Nice. Some of the group have already arrived in Israel, he said.

PA condemns conference hosted by hard-line Rabbi

BETHLEHEM (Ma'an) -- The Palestinian Authority condemned the Israeli government on Wednesday for allowing a conference hosted by a hard-line Rabbi to take place Tuesday in the Pisgat Zeev settlement in East Jerusalem.

"The Israeli authorities’ ongoing and consistent tolerance towards hate speech and incitement against Palestinians leads to actions," director of the PA's media center Ghassan Khatib said Wednesday.

The conference was hosted by Rabbi Yitzshak Shapiro, a co-author of the notoriously racist "King's Torah", and called for halting construction of a Palestinian school in between Pisgat Zeev and Nabi Taakov settlements in East Jerusalem, as well as preventing Jewish girls from dating Arab men.

In addition, the conference demanded that the Jerusalem light railway project should be banned from passing through Palestinian neighborhoods, a PA statement said.

"In the name of freedom of speech, settlers are given freedom of incitement and freedom to use violence against Palestinians," Khatib added.

The Palestinian Government Media Center "calls upon the Israeli authorities and the government to take serious actions to prevent continuing settler incitement and violations.

"We, also, call upon the international community to hold the Israeli government accountable for permitting incitement and violence of settlers to go unpunished."

The "King's Torah", which has been banned from sale in Israel, reportedly says babies and children of Israel's enemies may be killed in certain circumstances since "it is clear that they will grow to harm us."

"Anywhere where the influence of gentiles constitutes a threat to the life of Israel, it is permissible to kill them," the authors wrote.

Britain denies entry to Israeli rabbi who advocated killing of non-Jews

 U.K. Border Agency sends Rabbi Yosef Elitzur letter signed by the home secretary, informing him that he could not enter Britain for the next three years.

The U.K. Border Agency is prohibiting fundamentalist Rabbi Yosef Elitzur, co-author of the controversial book "The King's Torah" ("Torat Hamelech" ), from entering Britain, the Jewish Voice website reported on Wednesday.

Elitzur received a letter last month from the U.K. Border Agency, signed by the home secretary, informing him that he could not enter Britain for the next three years.

The July 20 letter, which appears on the website, cites the British law forbidding entry to anyone who writes, publishes or distributes material "fomenting or justifying terrorist violence ... and seeking to provoke others to commit terrorist acts." The book says Jews may kill gentiles, among other things.

The site says Elitzur was banned from Britain because of the book, published in 2009, and cites Elitzur's statement, "If the Jews don't have quiet, the Arabs won't have quiet. If the Arabs win because of violence against the Jews, the Jews will win by violence against the Arabs."

Israeli Rabbis Urge Refusal to Rent to Arabs, Echoing Nuremberg Laws

In a move reminiscent of Nazi-era Nuremberg Race Laws, a group of radical Orthodox rabbis led by the chief rabbi of Tzfat urged fellow Israeli Jews to refuse to rent apartments to non-Jews:

Dozens of Israel’s municipal chief rabbis have signed on to a new religious ruling that would forbid the rental of homes to gentiles in a move particularly aimed against Arabs, Haaretz has learned.
The religious ruling comes just months after a group of 18 prominent rabbis, including the chief rabbi of Safed, signed a call urging Jews to refrain from renting or selling apartments to non-Jews.
…The rabbis’ letter…urges Jewish owners of apartments to reconsider renting their properties to Arabs since it would deflate the value of their homes as well as those in the neighborhood.
“Their way of life is different than that of Jews,” the letter stated. “Among [the gentiles] are those who are bitter and hateful toward us and who meddle into our lives to the point where they are a danger.”
The rabbis also urge neighbors of anyone renting or selling property to Arabs to caution that person. After delivering the warning, the neighbor is then encouraged to issue notices to the general public and inform the community.
“The neighbors and acquaintances [of a Jew who sells or rents to an Arab] must distance themselves from the Jew, refrain from doing business with him, deny him the right to read from the Torah, and similarly [ostracize] him until he goes back on this harmful deed,” the letter reads.

What is especially significant about this development is that the municipal rabbis are employees of the State, which means that the nation is, in effect, endorsing their views…unless it renounces them.  And so far it hasn’t.  The attorney general has refused to take up the matter.  Nor has the chief rabbi of Israel, who is technically the boss of the municipal rabbis.  Tzfat’s chief rabbi, Shmuel Eliyahu, is among the most extremist in his views of Palestinian Israelis and many are seeking to bring a charge of incitement against him for this and his previous remarks.
Here is the chief rabbi’s reply:

The Chief Rabbinate is responsible for matters of Jewish law and professional issues pertaining to municipal rabbis. Theoretically, the two chief rabbis can summon a municipal rabbi for a disciplinary hearing if the attorney general concludes he has exceeded his authority or acted improperly. Such action has rarely been taken.
Oded Weiner, director general of the Chief Rabbinate, told Haaretz that the institution “does a great deal for interreligious dialogue, worldwide and with the Palestinian Authority [!].” But Weiner added that “every rabbi in his city says what is in his heart.”
Weiner said that in the past, chief rabbis handled such issues quietly with the individuals involved. “I have not seen the letter the municipal rabbis signed,” he said. “When we receive a query from any quarter, I’m sure the chief rabbis and the Council of the Chief Rabbinate will consider the matter.” Weiner said Chief Rabbi Yona Metzger would not take the issue to the council on his own initiative.

Apparently, decentralization of authority works well for rabbis when they wish to permit themselves to express the overt racism that “is in their hearts.”  But were a rabbi to be overly sympathetic to Palestinians (little likelihood of that I recognize), then all of a sudden the chief rabbi would invoke the power invested in him to take swift action.
In response, a group of prominent Israelis have demanded the immediate firing of the state-funded rabbis:

A group of public figures, intellectuals and academics have asked [attorney general] Weinstein to immediately suspend any public servants among the rabbis who signed the document, those “who trample underfoot the pledges of the Declaration of Independence on which Israel was founded, turn Judaism into racism and openly break the law prohibiting incitement to racism.”

Israeli blogger Idan Landau and others have noticed the ironic historic echo of the Nazi-era race laws which severely restricted social, commercial, sexual and professional contacts between Jews and non-Jews.  Interestingly, Landau displays this 1939 document which allows non-Jews to break leases signed with Jewish tenants and generally seeks ways of constricting Jews so they will be forced to live only in Jewish-owned property.  Even here though, the Nazi authorities did not explicitly reject the notion of a non-Jew renting to a Jew.  By the time they passed Law 234 (presumably after 1939) though, even this was withdrawn:

Law #234 told landlords that they could no longer rent to Jews. This made many Jews homeless, since a Jew kicked out of his home could not find any other place to rent. These Jews were then picked up by the police and sent to murder camps.

Israeli authorities must address this issue firmly or they risk become facilitators of the kind of racism and hatred which Jews suffered in Nazi-era Germany.  And a prime minister’s rap on the knuckles delivered mainly for foreign consumption is not enough.  There must be consequences.  Isn’t it enough that the Carmel fires have made Israel a punchline for bad jokes, that the country should allow this too to add to the black eye?  Diaspora Jewish leaders too have a responsibility to staunch the blood draining from the wounds of Israeli democracy through such wounds.
Do we really want to go down that road (again)?

And lest anyone attempt to argue that these rabbis are pure crackpots not representing anyone, I remind you that the Israel Democracy Institute 2010 survey found that 46% of Israeli Jews said they would be “bothered” by having Israeli Palestinians as neighbors.  This was higher than the number which would be troubled by having gay, mentally ill, foreign workers, or ultra-Orthodox neighbors.

Editorial in Orthodox ‘family magazine’ advocating death camps for Palestinians

Back in the days of the Shoah, one of the slogans of the Jew haters was: “Jews to the Ovens.” Now, it causes me anguish to say, we have Israeli Orthodox rabbis saying the same about the Palestinians.
Thanks to Cicero for pointing me to a shocking passage in an Israeli Orthodox “family magazine,” Fountains of Salvation, which suggests that Israel will create death camps for Palestinians in order to wipe them out like Amalek.  The article attacks Israeli rabbis who dispute the letter recently circulated from pro-settler extremist rabbis which urged that no Israeli Jew rent apartments or homes to Israeli Palestinians.  It chided them for being “politically correct” and refusing to do their jobs and educate the populace in the true path of Torah (which is presumably to hate Palestinians).
The last paragraph (page 4 of the original) though is the whopper:

It will be interesting to see whether they leave the assembly of the Amalekites [Palestinians] in extermination camps to others, or whether they will declare that wiping out Amalek is no longer [historically] relevant.  Only time will tell…

A few words of explanation.  There is a Biblical command for Jews to wipe out Amalek because of the viciousness with which that people attacked Israelites.  Essentially, this is a Jewish call to commit genocide against Amalek.  We should note that the Bible records such Jewish campaigns against other tribes as well (Moabites, Jebusites) and no doubt others did the same to their enemies.

Rabbis throughout the ages have allegorized the reference to Amalek to connote any sworn enemy of the Jewish people from Hitler to Barack Obama (yes, prominent American Orthodox Jews wrote such garbage before the last election).  But this is the first time I’ve ever read any Orthodox publication calling for committing genocide against Palestinians.

As Cicero pointed out to me, the articulation of this passage doesn’t only refer to Palestinians (though most likely this was specifically who the writer had in mind given the context).  It can refer to any enemy of the Jewish people including you or me.

Now a word on who is behind this publication: it is the cream of the crop of the radical right-wing Israeli Orthodox rabbinate.  It was founded by the former chief rabbi of Safed, whose son currently holds that position and who circulated the letter I refer to above.  Another is the chief rabbi of Ramat Gan and finally Rabbi Avinar, suspected of sexually abusing a troubled woman who approached him for spiritual advice.  Each of them holds paid government sinecures, allowing them to spew hate on the dime of the Israeli taxpayer.

This raises the important question: why does the U.S. government allow tax-deductible contributions to Israeli charities like Chabad given their propagation of such genocidal rhetoric?

Cicero first learned about the Chabad article from Udi Aloni’s Ynet column, which pointed it out.  He points out that it has been his custom in criticizing Israelis who support the Occupation to attack the liberal elite which is characterized by the slogan “shooting and crying.”  Instead, he says he now will have to pay closer attention to the radical Orthodox who “shoot and laugh.”  Aloni imagines the young Orthodox boy reading this publication in his synagogue where it’s distributed, who conjures to himself with a smile on his face the picture of Palestinians standing behind barbed wire in such a camp.  This is the legacy these rabbis are bequeathing to their young followers.

Finally, since I know people of all ideological stripes may read into this story what they wish, I want to make clear that this is not Judaism.  These wicked men may be Jews and rabbis, but they don’t represent normative Judaism any more than Osama bin Laden represents normative Islam.  Do not make the mistake of conflating this idiocy with all of Israel or all of Judaism.  Yes, these men are dangerous, they are hateful, and they must be challenged.  But there is another face of Judaism and another face of Israel (though that is becoming increasingly difficult to see I concede).
